Has your driver’s license been suspended or revoked? Driving is a privilege, not a right!!  Usually, a person will lose their driving privileges if they are convicted of drinking and driving (OWI / DUI) on multiple occasions. I can help you reinstate your driver’s license so you can legally drive again!

  • The State of Michigan requires that a person’s driver’s license be revoked by the Secretary of State (SOS) for a minimum of 1 year if the person receives 2 OWI / DUI convictions within seven years.
  • If a person receives 3 OWI / DUI convictions within ten years, the Secretary of State must revoke their driver’s license for a minimum of 5 years.

The driver’s license revocations by the State of Michigan are mandatory if you fall into one of the above categories.  There is no way to avoid them, and you will not automatically get your license back after the one or 5-year period is up!  You must request a hearing with the Secretary of State before you can get approved.  This process is not easy.  However, there are steps to take to increase your odds of obtaining a driver’s license.

To obtain driving privileges again, the driver whose license was revoked must apply for an administrative hearing before the Secretary of State.  However, a person can only apply for a reinstatement hearing once a year.  That is why it is imperative to hire an attorney with extensive experience with this process.  The process is complicated and can be very intimidating if you are unfamiliar with the steps.  I cannot make it less difficult, but I can make it MUCH easier to understand.

Serious Charges Requires Serious Representation

When you attend the administrative hearing, you must go before a hearing officer and prove by clear and convincing evidence that you no longer have a drinking problem or that your drinking problem is under control. This means that you must have been sober for at least a year, have a support system in place, and that you will not be a safety threat to other drivers. Hearing Officers have complete and sole discretion as to whether or not you are granted driving privileges again.

Having an experienced attorney represent you before these hearing officers make all the difference.

Your Guide through the process

In order to get a hearing before a Secretary of State Hearing Officer, a number of requirements must be met. I will guide you through each step and make sure you properly submit all of the necessary documents.

Step 1. I will meet with you to review your eligibility and discuss everything that will need to be completed before we can request a hearing. The Secretary of State requires the following before a hearing will be granted:

  • Hearing Request Application
  • Alcohol/Substance Abuse Evaluation
  • Letters of Support

The Secretary of State also requires a 10-panel drug screen with a substance abuse evaluation. If you do not have a provider available who can help with this, I provide help in recommending someone who can do the necessary evaluation and testing. I also can provide sample letters of support to help understand what the Secretary of State is looking for.

Step 2. I review all of the documents submitted and suggest modifications if necessary.  I review the letters of support and ensure they have all the required information. Any missing or inaccurate information can result in disqualifying the letter, so it is crucial to have an experienced attorney review them for accuracy.  I also review the Secretary of State forms and make sure all the information is accurate and complete.

Lastly, I review the Substance Abuse Evaluation and make sure all of its information is consistent with what the Secretary of State has on file. For example, suppose something is missing or inaccurate in the Substance Abuse Evaluation. In that case, the hearing officer will claim that the evaluation is inaccurate because the evaluator did not have accurate information.  Once everything is ready, I will file the documents with the Secretary of State for you and follow up with them about scheduling a hearing.

Step 3. Before the hearing, I will walk you through the process and discuss what to expect at the hearing.  At these hearings, there are specific things the Hearing Officer is looking for in order to grant you your driver’s license back. I guide you through these items and get you comfortable with what I will ask you at the hearing, what the Hearing Officer is likely to ask, and how to put you in the best possible light.
